Texas Mother Alleges Obstetrical Negligence During Birth of Child

In Harris County, Texas, a mother named Yara Y. Martinez is suing Dr. Wigberto Soto for medical malpractice after her newborn baby, Y.P.M., suffered serious injuries during birth. Martinez was admitted to Memorial Hermann Hospital Southeast on July 11, 2017, for labor induction under Dr. Soto’s care. Despite concerns with the baby’s heart rate, labor progressed slowly. On July 12, Martinez faced complications during delivery, leading Dr. Soto to use forceps to assist. However, the forceps slipped, causing severe problems with the baby’s heart rate. An emergency C-section was performed, but Y.P.M. was born unresponsive and needed immediate care from the NICU team. Y.P.M. suffered multiple skull fractures and brain hemorrhages, requiring intensive care for ten days. The child continues to have health issues because of these injuries. Martinez claims Dr. Soto didn’t properly assess her or the baby’s condition, misread heart monitor readings, misused the forceps, and provided inadequate care, all leading to her child’s injuries. She’s seeking compensation for medical expenses, pain and suffering, and other damages.
