A woman’s malpractice lawsuit over the death of her husband is back in court. Here’s what happened:
The Situation: The patient had surgery for an injury to his leg. Even though he had a previous history of forming a blood clot, the patient was not prescribed any anticoagulant after the leg surgery. Five days later, he died of a pulmonary embolism caused by deep vein thrombosis, or a blood clot, in his leg that broke off and traveled to his lungs.
The Dispute: The trial judge granted summary judgment in favor of the defendant and dismissed the case prior to a trial. Earlier this week, the Appeals Court reversed the decision of the trial court and found there was enough evidence to have the case proceed to a jury trial. As a result of the reversal, the patient will have her day in court.
