$47 Million awarded to Tennessee family in birth injury case

In what may be the largest medical malpractice verdict ever awarded in Tennessee, a jury recently awarded $47 million in a case involving catastrophic birth injuries sustained during labor and delivery. The delivery took place in September of 2018, at Ascension Saint Thomas Hospital Midtown. The allegations were that when the mother and baby’s health started to decline during labor, the medical team failed to speed up the delivery, which resulted in the infant being born lifeless, limp and not breathing. She was diagnosed with Hypoxic-Ischemic Encephalopathy (HIE) which is a severe brain injury caused by lack of oxygen. She will now live her life suffering from permanent brain damage, epilepsy, cerebral palsy & other developmental delays.
